The Language from HB 4827
(Mental Health Courts) was creatively tagged on to HB 1300
and PASSED BOTH HOUSES.
HB1300 is sitting on the Governor's desk waiting for his
signature!
House Bill 4827 was intended to establish a method
for supporting the operation of Mental Health Courts in
Illinois. Although the original bill HB
4827 is in the Senate Rules Committee, it no longer matters as the language
from HB 4827 was creatively tagged on to HB1300. As amended, HB1300
amends the Counties Code, providing that a county board may enact by ordinance
or resolution a $10 fee to be paid by the defendant on a judgment of guilty or
a grant of supervision under specified provisions of the Unified Code of
Corrections to be placed in the county general fund and used to finance the
county Mental Health Court.
HB 1300
as amended ((Mental Health Court fee) passed the Senate on
5/19/04 and the House Concurred on 5/26/04. HB 1300 is now sitting
on the Governor's desk. |

The
establishment of Mental Health Courts has been one of NAMI's main advocacy
strategies to address the stark reality that jails and prisons have become
the nation's depository for people with severe mental illnesses. Mental
Health Courts are designed to create effective interactions between the
criminal justice system and mental health systems by putting procedures in
place to divert non-violent offenders with serious mental illness from
jails and place them into appropriate community programs. |

NAMI
Illinois, in agreement with the Illinois Sheriff's Association (ISA)
ardently supports the creation of a "Mental Health Court System.” |
